These terms cover the BidByText website and waitlist, operated by JJSmith Group, Inc. ("we," "us"). Using the site means you agree to them. Terms for the paid service will be provided before any account is opened or any money changes hands.
Joining the waitlist costs nothing and commits you to nothing. We take contractors in the order they sign up, as capacity allows. A place on the list is not a promise of service, a price, or a launch date.
BidByText drafts itemized bids from photos, measurements, and notes supplied by a homeowner, priced with rates the contractor sets. A bid is a draft until the contractor approves it. The contractor is responsible for every bid sent under their name, for confirming scope on site, and for the work itself. BidByText is not a contractor, does not perform work, and is not a party to any contract between a contractor and a customer.
Photos, voice notes, text, bids, and approvals you submit remain yours. You give us a license to store, process, and display them to the people on your bid so the service can work. You are responsible for having the right to share what you upload, including photos of a customer's home.
Do not use the site to send spam, to submit information about people who did not agree to it, to break the law, or to probe or disrupt the service.
The site and the waitlist are provided as is. Drafted bids are estimates built from what was submitted; quantities and prices can be wrong, and the contractor must check them before sending. To the fullest extent the law allows, we disclaim all warranties and are not liable for lost profits, lost jobs, or indirect damages arising from use of the site. Where liability cannot be excluded, it is limited to the amount you paid us in the prior twelve months, which for the waitlist is zero.

We may change these terms by updating this page; the date at the top will change. We may close the waitlist or decline service to anyone at our discretion. You may leave the waitlist at any time by contacting us.
These terms are governed by the laws of the Commonwealth of Kentucky. Disputes will be handled in the state or federal courts serving Nelson County, Kentucky.
